1 – Scope

The general terms and conditions (hereinafter referred to as “GTC”) apply to all legal transactions that are concluded via the online shop www.hadorn.com. The online shop is operated by Hadorn Home GmbH (hereinafter referred to as “Hadorn”).

The general terms and conditions also apply to all legal transactions that are concluded within the framework of Hadorn's showrooms. In the showrooms, customers can experience advice personally and view carpets, as well as buy them at retail prices

 

Hadorn reserves the right to change these terms and conditions at any time. The version of these General Terms and Conditions valid at the time of the order is decisive and cannot be changed unilaterally for this order. Conditions of the customer that conflict with or deviate from these General Terms and Conditions will not be recognized.

The range of products in the online shop, explicitly also in our showrooms, is aimed at international customers. Deliveries are made to addresses worldwide. Delivery costs may vary depending on the delivery zone. The offer is valid as long as the product can be found in the online shop via the search engine and/or stocks last.

For all product orders that require a minimum age of 18, the customer confirms compliance with these legal provisions with the order.

Orders in non-household quantities can be rejected without justification.

 

2 - Information

2.1 Product and Price

Images of products in advertising, brochures, online shop, etc. are for illustration purposes and are non-binding.

All sales prices published in the online shop are final prices that include all taxes (esp. VAT), any early recycling fees (ARF), costs for packaging/s and any other duties, fees or costs. Deviations can only arise in the case of delivery in the respective zones. Hadorn reserves the right to change the prices of the products and services offered at any time. The price in the online shop at the time of the order is decisive for the conclusion of the purchase contract.

If the customer orders a product that is in one of our warehouses abroad, the customer, as the importer, is liable for the Swiss import tax and any customs duties for the product delivered. The customer hereby authorizes and commissions Hadorn to carry out the import customs declaration for the product delivered in Switzerland in the name and on behalf of the customer and to pay the Swiss import duties (import tax and any customs duties). Customers pay the expected Swiss import duties in advance to Hadorn together with the purchase price. Any difference to the Swiss import duties actually incurred will be reimbursed to the customer. Hadorn provides the customer with an import duty notice in a suitable form or enables it to be accessed electronically. The customer must raise any objections to the import duty notice within seven (7) working days of receipt or availability. After this period has expired, the customer cannot resort to Hadorn for any deficiencies in the import duty notice.

2.2 Availability and Delivery Time

Hadorn attaches great importance to providing up-to-date and accurate information on availability and delivery times in the online shop. However, there may be delays in delivery at Hadorn, particularly due to production or delivery bottlenecks. All information on availability and delivery time is therefore without guarantee and can change at any time.

 

3 – Conclusion of the contract

The products and prices in the online shop are considered an offer. However, this offer is always subject to the contract-dissolving condition of an impossibility of delivery or an incorrect price quotation.

The purchase contract for Hadorn products is concluded as soon as the customer places their order in the online shop, in one of the branches or by e-mail (hereinafter referred to as “purchase contract”).

The arrival of an online order is indicated to the customer by means of an automatically generated order confirmation from Hadorn to the e-mail address you provided. The receipt of the automatically generated order confirmation does not contain any promise that the product can actually be delivered. It merely shows the customer that the order placed has arrived at the online shop and the contract with Hadorn has therefore been concluded subject to the condition of delivery and the correct price indication.

 

4 – Delivery date

With the order confirmation, the customer is informed of a provisional delivery date or the customer is contacted and an individual delivery date is agreed.

If Hadorn is in default of delivery, the customer (except for special orders) has the right to withdraw from the contract from the 30th calendar day after the originally announced delivery date. In this case, Hadorn will reimburse the customer for amounts paid in advance. There are no further claims against Hadorn.

 

5 – Delivery / Store Collection

In the case of Hadorn products, customers have all the delivery and collection options that are listed in the online shop under “Delivery and collection”.

If the customer does not accept the ordered products on the agreed or announced delivery date, Hadorn can dissolve (cancel) the contract and charge the customer for the delivery costs incurred and any loss in value.

If the customer does not collect the products ordered from a branch (collect from a branch) within 14 calendar days of the branch being ready for collection, Hadorn can dissolve (cancel) the contract.

6 – Obligation to audit

The customer must immediately check delivered or collected products for correctness, completeness and delivery damage.

In the case of forwarding deliveries, any delivery damage must be noted on the delivery note.

Delivery damage, incorrect and incomplete deliveries are to be reported for all products within 7 calendar days from the time of collection or delivery. Customers are not allowed to put such a product into operation. You must keep it in the original packaging as received and follow the instructions of the guided returns process.

 

7 - Liability and Disclaimer

Liability is based on the applicable legal provisions. However, Hadorn is in no case liable for (i) slight negligence, (ii) indirect and indirect damage and consequential damage and lost profit, (iii) unrealized savings, (iv) damage from delay in delivery and (v) any acts and omissions of the auxiliary persons of Hadorn, be it contractual or non-contractual.

Furthermore, Hadorn rejects liability in the following cases:

  • improper, non-contractual or illegal storage, adjustment or use of the products;
  • failure to maintain and/or improper modification or repair of the Products by Customer or a third party;
  • neglected maintenance and/or improper modification or repair of the products by the customer or a third party

 

 

8 - Payment

8.2 Retention of Title

Ordered products remain the property of Hadorn until full payment has been made. Hadorn is entitled to make a corresponding entry in the retention of title register.

 

9 – Modification of Order or Cancellation

Orders oblige customers to accept the products. Hadorn can accept subsequent changes or cancellations of customer orders at its own discretion and charge a processing fee of 20% of the cancelled order value, but at least CHF 50.00, as well as any loss in value of the cancelled products since they were ordered.

If a (partial) delivery impossibility (condition subsequent) occurs after an order or the conclusion of a contract in accordance with Section 3, the customer will be informed immediately by e-mail or telephone. If the customer has already paid, this amount will be refunded. If payment has not yet been made, the customer is released from the obligation to pay. Further claims due to delay in delivery or delivery failure are excluded.

 

10 - Return of goods free of defects

Under the conditions listed in the return guidelines, Hadorn grants the right to return the ordered products within a maximum of 30 calendar days.

Customers must report the return of the products to a customer advisor. The products are to be packed professionally with all accessories. Damaged products will not be taken back or will be charged in full to the customer.

If customers make use of their right of return, Hadorn will refund the entire purchase price.

 

11 – Privacy

The data protection declaration applies to the processing of personal data by Hadorn.

 

12 - Copyright Notice

All rights, specifically copyrights, to these General Terms and Conditions are held by Hadorn.

Any duplication, distribution or other use is prohibited and only permitted with the express written consent of Hadorn. In the event of a breach of this requirement, Hadorn reserves the right to take all legal action.
