1 - Scope
The General Terms and Conditions (hereinafter referred to as "GTC") apply to all legal transactions concluded via the online store www.hadorn.com. The online store is operated by Hadorn Home GmbH (hereinafter referred to as "Hadorn").
The General Terms and Conditions also apply to all legal transactions concluded in the Hadorn showrooms. In the showrooms, customers can obtain personal advice, view carpets and purchase them at retail prices.
Hadorn reserves the right to change these conditions at any time. The version of these General Terms and Conditions valid at the time of the order is decisive and cannot be changed unilaterally for this order. Any terms and conditions of the customer that conflict with or deviate from these General Terms and Conditions will not be recognized.
The offer in the online store, expressly also in our showrooms, is aimed at international customers. Deliveries are made to addresses worldwide. Delivery costs may vary depending on the delivery zone. The offer is valid as long as the product can be found in the online store via the search engine and/or while stocks last.
For all product orders that require a minimum age of 18 years, the customer confirms compliance with these legal provisions when placing the order.
Orders in quantities not customary for households may be rejected without giving reasons.
2 - Information
2.1 Product and price
Images of products in advertising, brochures, the online store, etc. are for illustrative purposes only and are not binding.
All sales prices published in the online store are final prices that include all taxes (in particular VAT), any advance recycling fees (ARF), costs for packaging and other charges, fees or costs. Deviations may only occur for delivery to the respective zones. Hadorn reserves the right to change the prices for the products and services offered at any time. The price in the online store at the time of the order is decisive for the conclusion of the purchase contract.
If the customer orders a product that is located in one of our warehouses abroad, the customer is liable as the importer for the Swiss import tax and any customs duties for the delivered product. The customer hereby authorizes and instructs Hadorn to make the import customs declaration for the product delivered to Switzerland in the name and for the account of the customer and to pay the Swiss import duties (import sales tax and any customs duties). The customer pays the expected Swiss import duties to Hadorn in advance together with the purchase price. Any difference to the Swiss import duties actually incurred will be refunded to the customer. Hadorn shall provide the customer with an import duty notice in a suitable form or enable it to be retrieved in electronic form. The customer must raise any objections to the import duty notice within seven (7) working days of receipt or availability. After this period has expired, the customer can no longer contact Hadorn regarding any deficiencies in the import duty notice.
2.2 Availability and delivery times
Hadorn attaches great importance to providing up-to-date and accurate information on availability and delivery times in the online store. Nevertheless, Hadorn may experience delays in delivery, in particular due to production or delivery bottlenecks. All information on availability and delivery times is therefore without guarantee and may change at any time.
3 - Conclusion of contract
The products and prices in the online store constitute an offer. However, this offer is always subject to the contract-dissolving condition of impossibility of delivery or incorrect pricing.
The purchase contract for Hadorn products is concluded as soon as the customer places his order in the online store, in one of the branches or by e-mail (hereinafter referred to as the "purchase contract").
The receipt of an online order is indicated to the customer by an automatically generated order confirmation from Hadorn to the e-mail address provided by you. The receipt of the automatically generated order confirmation does not contain any promise that the product can actually be delivered. It merely indicates to the customer that the order placed in the online store has been received and that the contract with Hadorn has therefore been concluded, subject to availability and correct pricing.
4 - Delivery date
With the order confirmation, the customer is informed of a provisional delivery date or the customer is contacted and an individual delivery date is agreed.
If Hadorn is in default of delivery, the customer (except in the case of special orders) has the right to withdraw from the contract from the 30th calendar day after the originally announced delivery date. In this case, Hadorn will refund the customer any amounts paid in advance. There are no further claims against Hadorn.
5 - Delivery / collection from the store
For Hadorn products, the customer has all delivery and collection options listed in the online store under "Delivery and collection".
If the customer does not accept the ordered products on the agreed or announced delivery date, Hadorn may terminate (cancel) the contract and charge the customer for the delivery costs incurred and any loss in value.
If the customer does not collect the ordered products from a branch within 14 calendar days after they are ready for collection (collection from a branch), Hadorn may dissolve (cancel) the contract.
6 - Obligation to inspect
The customer must immediately check delivered or collected products for correctness, completeness and delivery damage.
In the case of forwarding deliveries, any delivery damage must be noted on the delivery bill.
Delivery damage, incorrect deliveries and incomplete deliveries must be reported for all products within 7 calendar days from the time of collection or delivery. Customers may not put such a product into operation. You must keep it in the original packaging as you received it and follow the instructions of the guided return procedure.
7 - Liability and exclusion of liability
Liability is governed by the applicable statutory provisions. However, in no event shall Hadorn be liable for (I) slight negligence, (II) indirect and consequential damages and lost profits, (III) unrealized savings, (IV) damages resulting from delay in delivery, and (V) acts and omissions of Hadorn's agents, whether contractual or non-contractual.

8 - Payment
8.1 Payment options
The payment option(s) will be communicated to the customer in the seller's online store.
8.2 Purchase on account with installment facility (POWERPAY)
MF Group / POWERPAY offers the payment method "purchase on account" as an external payment service provider. With the single invoice, you can simply pay for your online purchase by invoice. If you choose not to pay within the specified time frame, you will receive a monthly invoice with an order overview in the following month.
When the purchase contract is concluded, POWERPAY takes over the invoice claim and processes the corresponding payment modalities. When purchasing on account, you accept POWERPAY's GTC in addition to our GTC. (powerpay.ch/en/agb).
8.3 Retention of title
The ordered products remain the property of Hadorn until full payment has been made. Hadorn is entitled to make a corresponding entry in the retention of title register.
9 - Modification of the order or cancellation
Orders oblige the customer to accept the products. Hadorn may accept subsequent changes or cancellations of customer orders at its own discretion and charge a processing fee of 20% of the canceled order value, but at least CHF 50.00, as well as any loss in value of the canceled products since the order was placed.
If a (partial) impossibility of delivery (condition precedent) occurs after an order has been placed or a contract concluded in accordance with section 3, the customer will be informed immediately by e-mail or telephone. If the customer has already paid, this amount will be refunded. If payment has not yet been made, the customer shall be released from the obligation to pay. Further claims due to delayed delivery or non-delivery are excluded.
10 - Return of faultless goods
Hadorn grants a right to return the ordered products within a maximum of 30 calendar days under the conditions set out in the return policy.
Customers must report the return of the products to customer service. The products must be properly packed with all accessories. Damaged products will not be taken back or will be charged to the customer in full.
If the customer makes use of his right of return, Hadorn will refund the entire product price. Any shipping costs incurred will not be included in the refund.
11 - Refund
At Hadorn we reserve the right to offer refunds to customers in the form of store credit or vouchers. This may be in situations where a refund of the purchase price is not possible or offered as an alternative to a direct refund. We reserve the right to decide on the type of refund depending on the individual circumstances of the case.
12 - Data protection
The privacy policy applies to the processing of personal data by Hadorn.
13 - Copyright notice
All rights, in particular copyrights, to these General Terms and Conditions are held by Hadorn.
Any reproduction, distribution or other use is prohibited and only permitted with the express written consent of Hadorn. Hadorn reserves the right to take all legal action in the event of a breach of this provision.
14 - General Terms and Conditions for SMS Marketing
Promotions, offers and updates) will be accepted by Hadorn Home GmbH to the number provided, including messages sent by autodialer. Consent is not a condition of purchase. The frequency of messages may vary. Message and data charges may apply depending on your mobile service provider.
